Hello from Railway Paths

Following the DfT's block on transferring the land to GSWR, at the suggestion of DfT, I have today written to the CEO of Worcestershire County Council to offer WCC the route for £1. (The DfT don't want the land returned to them.)

If only someone had the money for the bridges! At least WCC could apply for a grant variation to maintain them and use the element of various highway and transport acts to formerly claim ownership of these bridges!

Considering it was/is DfT/central gov that increased vehicle sizes & weights, & central gov planning that allows (& even enables) large vehicles to regularly operate from sites without suitable infrastructure, & that it's central gov that takes all the tax revenues from the vehicles,
then shouldn't DfT be providing the funding?

Railway owned bridges load liabilities are limited to that of the 1922 Highway Act as in 24t, confirmed in detail in SI no.1705 of 1972.

To pacify the various 'Boards' when raising HGV weights, non-highway owned bridges liabilities were partially transferred to highways under the 1968 Transport Act, including all trunk road bridges and with the additions in the 1980 Highway Act set up a framework for any bridge to transfer from the railway to highways under set circumstances.

Unfortunately for the GWSR these bridges cannot even meet their requirements of the 1922 Act and would find a transfer of ownership under later provision tricky in this condition, but not impossible,

The A435 (T) bridge should have transferred to highways but due to the run down / closure of the line BRB probably didn't care at the time. Whilst the provision of a transfer remains today, enacting it may be more challenging!
