My London Freedom Pass with the Red Ross chip isn’t working anymore and I have order a new one so I’m in a waiting game and going to work been advised by the Freedom Pass office that I can still use it on buses but tell them the issue which I have but started think to myself I hope I ain’t fare evading because the date expires March 2026 plus some drivers understand outside London than some in London.

https://www.londoncouncils.gov.uk/services/freedom-pass/lost-stolen-or-damaged-pass says, under the section Faulty Freedom Pass:

Please note that before sending in your faulty pass to be tested, it is advisable to keep your current pass to present for visual inspection enabling you to continue travelling while you are waiting for your replacement pass to arrive. Please note that when presenting your pass for visual inspection, the transport operator's staff will inspect the pass closely to confirm its validity. Please note that it is at the discretion of Transport for London to allow you to continue your journey with a faulty pass. We suggest you also carry additional proof of identity and contact the helpline to replace your pass immediately.

This agrees with the suggestion that you can use it even though the chip has stopped working. In any case I would imagine that if you have the advice from the Freedom Pass Office in writing, that that would be an absolute bar to any penalty being imposed.
