Out of Court Settlement - DBS check

Hello,

Back in 2019 I made a stupid mistake not purchasing a ticket before getting on a train. This all resulted in a me paying an out of court settlement (all arranged via phone and email) and as far as I am aware that was the end of it.

Would anything from this incident show up on an enhanced DBS? I was interviewed by a plain clothes officer who interviewed me under caution and wrote it all down in a notebook that I signed. `i never spoke to anyone from the police as far as I know and never recieved anything related to prosecution or court.

Neither an out of Court settlement nor a Byelaw offence appears on an enhanced DBS check as neither is recordable (indeed, an out of court settlement would not even be in the criminal system). A RoRA conviction, by contrast, would appear.

The only place a Byelaw offence might come up is in a higher level of check than that, e.g. Developed Vetting* for a Government position. An out of Court settlement still wouldn't unless the settlement was arrived at once the matter had been passed to a Court but then withdrawn by agreement.

* And if you know how DV works, you'll know it's about whether what you tell them is the same as they find, i.e. are you hiding anything, and far less about any offences in and of themselves. The purpose of DV is essentially to establish if you could be blackmailed to reveal top secret information.

that's really helpful thank you, I am not interesting enough for developed vetting but require an enhanced DBS for a project I have just started and had a sudden panic that I might have accidentally not declared something.

just in case anyone is looking at this thread in the future - my DBS did not have anything related to my incident on it --> this was for working with children and adults. this may not be the same for everyone of course but just an FYI

Thanks.

It will be the same for everyone - an out of court settlement prior to a matter being brought before a Court is not something which would have any potential to appear on a DBS check.
