In practice, what it means here is that the railway are reluctant to prosecute people under 18, so don't normally do so - but if an under 18 takes this as an opportunity to frequently travel without a valid ticket, the railway has got the right to go to court.
So no one, whatever their age, should think that they don't need a ticket. When the railway catches up with them, there's still a risk of ending up in court.
