What protection is there for passengers delayed by services carrying passengers in excess of capacity?

I was delayed for 2 hours at Taunton due to a short formed (4 car 22x vice HST) at Taunton last month not being able to board myself, my partner, and our weekend's worth of luggage (a suitcase each). From my reading of the National Rail Conditions of Carriage, I don't believe we're actually entitled to any delay repay. Sure enough, XC have informed me that the service was actually delayed by 0 minutes (though I know it actually ran a few - but less than 30 - minutes late and that this is misinformed). Is it at all worth persuing any recourse, or does the wording of the NRCoT preclude it?

You are entitled to Delay Repay regardless of the cause of delay. That's all there is to it.

When this has happened to me in the past, I took a picture of the train in question and submitted it with my claim. It has always been accepted. I guess this is too late for you?

I’ve had countless claims accepted by northern when I’ve been unable to board jam packed trains. Generally after an appeal though

You’ll need to appeal - state the train was full and standing (this may or may not have been reported by the guard onboard) and state what journey you had to take in lieu of your original booked train.

The fact that the train you intended to catch ran on time is irrelevant - it's about the delay to you and your journey. I'd come back to CrossCountry explaining why you were unable to catch that service.

If you applied for DR through the web based forms it little surprise it was rejected. For something like this it will usually be better to write in and explain.

The more customer focused among train operators have in their form a selection of boxes you can check for "other delays" e.g. I could not board my train due to overcrowding, my booked assistance was not available, etc
